CHALMETTE, La. — A St. Bernard district judge denied attempts by port authorities to dismiss St. Bernard Parish Government’s lawsuit challenging the planned Louisiana International Terminal before trial, parish officials announced Saturday.
Parish President Louis Pomes said Judge Darren M. Roy of the 34th Judicial District Court overruled peremptory exceptions of no cause of action filed by the Board of Commissioners of the Port of New Orleans and the St. Bernard Port, Harbor and Terminal District.
According to Pomes, the decision clears the way for the parish’s legal challenge to proceed on the merits.
Parish government filed the suit to block Port NOLA from constructing the multi-billion-dollar terminal in St. Bernard Parish, arguing the agency lacks the jurisdictional authority to do so.
Port NOLA officials downplayed the ruling’s significance, noting that the court has not yet ruled on the legal substance of the parish’s claims.
