Judge Backs State in Dune Condemnation Cases

The state can seize parts of oceanfront land for a beach replenishment project in Ocean County, a judge has ruled.

Superior Court Assignment Judge Marlene Lynch Ford ruled against 28 oceanfront property owners who had asked the judge to block the state Department of Environmental Protection’s attempts to acquire a portion of their land to build bigger beaches.

The ruling could help pave the way for a long-delayed beach replenishment project from the Manasquan to Barnegat inlets, an area that was among the hardest hit when superstorm Sandy roared ashore in October 2012.
