A legal challenge to the planned Louisiana International Terminal in St. Bernard Parish will move forward after a judge rejected an attempt by Port NOLA to have the case dismissed before trial.
The St. Bernard Parish judge’s decision came Saturday. It does not determine whether the port can legally build the proposed container terminal, but it means the parish’s lawsuit can continue.
St. Bernard Parish is seeking to stop the project, arguing that Port NOLA does not have the legal authority to build the terminal in the parish.
The Louisiana International Terminal is a proposed multibillion-dollar container facility in Violet. The project has received federal approval and is expected to significantly expand the region’s ability to handle cargo.
The project has drawn opposition from some St. Bernard Parish residents, who have raised concerns about increased traffic, industrial noise and air pollution, as well as potential damage to the area’s sensitive wetlands.
Port NOLA says Saturday’s ruling was procedural and does not address the merits of the parish’s arguments.
The port says work on the terminal is continuing while the legal case moves through the courts.
