A dredging company is suing the U.S. government, alleging breach of contract and negligence.
Weeks Marine Inc. filed a lawsuit Dec. 12 in the Houston Division of the Southern District of Texas against the United States of America, acting in the name of its agency, the U.S. Army Corps of Engineers, alleging the government failed to comply with the Contract Disputes Act.
According to the complaint, because of the Army Corps of Engineers’ negligence, Weeks Marine suffered monetary damages of $5,900,897.55 for the cause of Contango Operators Inc.’s damages regarding the construction of a pipeline.
The plaintiff alleges the U.S. Army Corps of Engineers failed to disclose the existence of the Contango’s pipeline while describing the existence of five other pipelines in the scope of the work in Atchafalaya Bar Channel .
Weeks Marine seeks trial by jury, an order finding the defendant liable for all damages sustained by plaintiff in the amount of $5,900,997.55 and all other equitable relief. It is represented by attorney Matthew F. Popp of Waits, Emmet & Popp LLP in New Orleans.
